Digital Millennium Copyright Act Notice

TempZap ("we," "us," or "our") respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act of 1998 (DMCA). As a temporary email service, we do not host or store user-generated content beyond the temporary emails that pass through our system. However, we are committed to responding to valid copyright infringement notices regarding any material accessible through our service.

What TempZap Does

TempZap provides temporary, disposable email addresses that receive emails from third parties. These emails are automatically deleted after 48 hours. We do not actively monitor or control the content of these emails. If you believe that an email received through our service infringes your copyright, please follow the process below.

Reporting Copyright Infringement

If you believe that your copyrighted work has been copied and is accessible via https://tempzap.com in a way that constitutes copyright infringement, please provide our designated DMCA Agent with the following information in writing:

  1. Physical or Electronic Signature: A signature (physical or electronic) of the copyright owner or a person authorized to act on their behalf.
  2. Identification of Copyrighted Work: A description of the copyrighted work you claim has been infringed.
  3. Identification of Infringing Material: A description of the material you claim is infringing, including the temporary email address (if known) and the approximate time the email was received. Because emails expire quickly, please act promptly.
  4. Contact Information: Your address, telephone number, and email address.
  5. Good Faith Statement: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy Statement: A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

Note: Under the DMCA, a physical mailing address is required. If you do not wish to disclose a personal address, consider using a PO Box or registered agent service.

Counter-Notification Procedure

If you believe that an email or content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our DMCA Agent including:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location where it appeared before removal (e.g., the temporary email address).
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled due to mistake or misidentification.
  4. Your name, address, and telephone number.
  5. A statement consenting to the jurisdiction of the Federal District Court for your address (or any judicial district if outside the United States).
  6. A statement that you will accept service of process from the person who filed the original DMCA notice.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If we do not receive notice of a court action within 10-14 business days, we may restore the removed material.

Processing Timeline

Upon receipt of a valid DMCA notice, we will:

  • Remove or disable access to the allegedly infringing material within a reasonable timeframe (typically 2-3 business days).
  • Attempt to notify the user (if we have an email address or account association) about the removal.

Note: Because temporary emails are automatically deleted after 48 hours, the infringing material may no longer be accessible by the time we process your notice. We recommend sending your notice as soon as possible.

Repeat Infringer Policy

TempZap maintains a policy of terminating, in appropriate circumstances, the optional accounts of users who are determined to be repeat infringers of copyrighted material. For users without accounts, we may block IP addresses or domains associated with repeated infringing activity.

Misrepresentation Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be subject to liability for damages (including costs and attorneys' fees).
