Counter-Notification Procedure

  • Identification of the material that was removed or disabled, and the location where it appeared before removal
 
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
 
  • Your name, address, and telephone number
 
  • A statement consenting to the jurisdiction of the Federal District Court for your address (or any judicial district if outside the United States)
 
  • A statement that you will accept service of process from the person who filed the original DMCA notice
 

Processing Timeline

 

Upon receipt of a valid DMCA notice:

 
  • We will remove or disable access to the allegedly infringing material within a reasonable timeframe
  • We will notify the user who posted the content about the removal
  • The removed content may be restored if we receive a valid counter-notification
 

Repeat Infringer Policy

 

TempZap maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of copyrighted material.

 

Misrepresentation Warning

 

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be subject to liability for damages.
